Mediation Services

Shireen Wetmore Mediation helps parties resolve labor and employment disputes, including PAGA actions, class and collective actions, and single-plaintiff and multi-plaintiff disputes. Over the past decade, Shireen has litigated hundreds of representative actions, including cases brought under California's Private Attorney's General Act (PAGA) as well as nationwide class and collective actions under the Fair Labor Standards Act and more. Her law firm practice included matters in state and federal court and before state and federal agencies. In nearly all of those matters, the parties on both sides of the "v" wanted more than anything to find resolution and put the matter behind them. Shireen has consistently helped parties achieve mutually beneficial settlements in even the most complex matters, facilitating agreements that empower all sides to resolve their disputes and focus on the future.

Class and Collective Actions

Class and collective actions come with unique challenges for all parties involved.  Such matters often require special approvals and apply different standards, making a mediator essential to bringing these cases to a swift resolution. Mediation gives the parties the opportunity to engage in a confidential exchange of information that can help avoid some of the costs of discovery and the uncertainty that comes with motion practice.  Shireen has experience with class and collective actions of all stripes.  Her prior law firm experience leading teams on labor matters gives her additional perspective on matters involving unionized employee populations.

Single Plaintiff Matters

Employment disputes take many forms, including failure to accommodate claims, claims of wrongful termination, harassment, whistleblower claims, retaliation, and discrimination claims based on membership in one or more protected classes.  In California, protected characteristics include: race, color, ancestry, national origin, religion, creed, age, disability, sex, gender, sexual orientation, gender identity, gender expression, medical condition, genetic information, marital status, military or veteran status, and reproductive health. See Gov. Code § 12940.

Shireen not only brings more than a decade of experience in private practice, but also the unique perspective of having served in house at a non-profit university. In single plaintiff matters, emotions often run high.  Shireen's human-centered approach helps parties get to the heart of their disputes.  Mediation gives these parties the opportunity to explore in a confidential setting whether pre-trial resolution is possible and empowers the parties to decide on a resolution that works for them.

PAGA Actions

The Private Attorney's General Act (PAGA) is unique to California. Through PAGA, a plaintiff is deputized by the Labor Commissioner to enforce the California Labor Code and seek civil penalties on behalf of themselves and other "aggrieved employees." These cases can be very complex, and settlements must be court-approved. In June of 2024, reforms were passed changing the PAGA landscape in California. Since then, PAGA filings have only continued to grow. Shireen's practice has taken her through many of the seminal cases in this space and she brings more than a decade of experience handling PAGA matters to each mediation.
